Mock Arbitration

PyeAssociates -John Alexander BrodieAfter the great success of our previous mock arbitration we will be holding another. 

Dame Timola Rice Davies is a well-known British producer and playwright. Her latest production, titled Expectations, is about the life and achievements of one of Liverpool’s most famous civil engineers, John Alexander Brodie.
As is tradition, a preview evening of the play was held just before release to the provinces, at which press and art-world critics were invited along with regular theatregoers. The venue selected was the Haliford Theatre, Guildswick, a small venue which seats 450 people.
Unfortunately, half way through the performance, one of the lighting booms collapsed onto the stage narrowly missing the actors but necessitating the theatre to be evacuated.

The contract between Rice Davies Productions Limited (RDP) and Haliford Theatre Company Limited (HTC) provided an entitlement for either party to resolve disputes under the contract by arbitration and RDP now seeks a declaration that HTC was not only in breach of contract but also negligent.
In its defence, HTC denies it was in breach contending that the lighting rack was interfered with by a member of the production crew during rehearsals the day before.
Further to this HTC challenges the arbitrator’s jurisdiction on those parts of the claim for damages which are not caught under the contract. 

The arbitrator will be Sir Rupert Jackson

The arbitration hearing will be held at Council Chamber, Stockport Town Hall on 30th June 2022 commencing at 6.00pm prompt and delegates are requested to be in their seats 5 minutes beforehand for introductions.
This is a joint CIOB/CIArb/CICES event and early booking is essential.

A light buffet will be provided from 5.30pm.

14 March 2019 - Mock Arbitration

Lady Elizabeth Spence lost her prize Andalusian stallion when he broke out of his stables one stormy night, bolted across meadows and onto a road only to be injured by a passing car. The car did not stop and the horse had to be put down. The stables had been part of a recently completed extensive development of outbuildings at Manor Hall, the home of Lady Elizabeth. On the fateful night the horse had spooked and kicked the stable doors off its cast iron hinges enabling him to break out. Lady Elizabeth brought a claim under the arbitration provision of the JCT Intermediate Building Contract 2011 against the architect and/or the builder for either negligent design or shoddy workmanship or both.

The Arbitrator is Paul Jensen, counsel for the Claimant and the Respondent will be provided by Kings Chambers, Manchester.

The arbitration hearing will be held at Council Chamber, Stockport Town Hall on 14 March 2019 commencing at 6.30pm prompt and delegates are requested to be in their seats 5 minutes beforehand for introductions.
This is a joint CIOB/CIArb event and early booking is essential.

21 June 2018 - CIArb Northwest Branch Event - DIY Adjudication
